OFFICIAL ENTRY FORM AND LIABILITY RELEASE

I, the undersigned Team Captain, have read, understand and agree to abide by the rules and regulations of the San Diego Offshore Invitational (the "Tournament") for the opportunity to participate in said event on September 7^th and 8^th, 2001. I agree to have at least one representative of my team attend the Captain's meeting on Thursday September 6^th, 6 PM at The Marlin Club (2445 Shelter Island Drive) for the purpose of reviewing the rules and to be notified of any modifications to said rules. I agree to review these rules and regulations with my entire team before the event and ensure that all team members agree to and follow said rules. I also understand that the Tournament relies on use of photographic evidence subject to arbitrary judging and agree to any decisions made by the panel of judges (the "Tournament Committee"). I agree that any and all decisions by the Tournament Committee concerning all aspects of the Tournament including but not limited to protests, use of polygraph testing, qualification or disqualification, financial disbursement, and rules interpretation are at the sole discretion of the Tournament Committee and are final and binding. I understand the risks involved in participating in an event at sea and I take full responsibility for the actions of my teammates and myself in regards to using common sense, good judgment, good seamanship and good sportsmanship during said event. I do hereby personally and on behalf of my heirs, successors, servants, assigns, executors, administrators, guardians, conservators and teammates hereby release, discharge, cancel, waive, covenant not to sue, acquit, hold harmless The Marlin Club of San Diego, it's directors, members, officers, representatives, attorneys, sponsors and assigns (collectively "The Club"), and agree to hold them free and harmless for, from, and against any and all claims, judgments, appeals, rights demands, costs, expenses, liabilities, obligations, claims, actions and causes of action of any character whatsoever, whether known or unknown, suspected or unsuspected, arising from negligence, intentional or otherwise, directly or indirectly connected or associated with the Tournament including but not limited to liabilities for personal injury, property damage, or wrongful death caused by such negligence or act (the "Claims"). I also agree to indemnify The Club against the Claims, and other costs, expenses and damages, including reasonable attorney's fees, resulting from any Claims made by me or my agents, teammates or successors-in-interest in connection with or arising out of the Tournament. Furthermore, I acknowledge that any photos or video submitted by me or my team during the Tournament become the property of The Club and may be used by The Club in the future. I understand that The Club reserves the right to refuse entry to any individual, captain, boat or team. I also agree and understand that as Team Captain, I am personally responsible for any and all taxes incurred through winning in this event, and will be required to submit IRS form W9 to receive financial awards. I have read and understand this release and I am fully aware of the potential dangers incidental to engaging in such activity and I understand the legal consequences of signing this release.
